If you default on a car payment, however, the finance company can take the car back without court order. But, in our experience, they usually wait until you are at least two payments behind before they repossess a car. 

Once the car is repossessed, you only have a short period of time to get the car back before it’s sold at auction. The finance company will usually require that you come up with the entire default, plus storage costs and repossession fees, before releasing the car. If you are caught in this unfortunate situation, one of our Seattle bankruptcy attorneys can advocate and negotiate on your behalf. In many cases, however, it's best to just let the car go at this point.

A Chapter 13 bankruptcy might allow you to get a car back after it’s been repossessed. However, once the car is sold at auction, there is no way of recovering it. And, if you file a Chapter 13 after the car is repossessed, you will most likely have to come up with the repo fees and the storage costs to get the car back.

It is a better idea to file the bankruptcy before the car is repossessed. Either a Chapter 7 or a Chapter 13 will stop the repossession. However, the finance company may be able to repossess the car in as little as a month after a Chapter 7 is filed. A Chapter 13 repayment plan will allow you to repay the car loan over three to five years and may offer ways of lowering the overall amount you pay on the loan.

Even with a court order, they have to have the sheriff come in your house to get it. The whole process for hiring the sheriff to repossess personal property is so expensive, it is rarely done. In most cases, the creditor would rather sue you for the money rather than get a court order for a return of the property.
